The loss of a loved one or friend can be a very difficult time. Your focus is on coping with your loss and arranging the funeral.

The collection and distribution of money, property and other assets belonging to a person following their death, where these are within the UK and the matters are not contested;

  • An average charge for this work would be £5,000.00-£7500.00 plus 20% VAT.
  • This estimate is just an average price based on recent instructions; the actual cost to you will depend on a number of factors which we will discuss with you if you decide to instruct us.
  • The charge is based on our average hourly charging-rate which ranges between £200-£315 per hour plus 20% VAT. We reserve the right to charge a percentage uplift based on the value of the estate, which would be additional to the hourly time charge. This additional percentage charge is in line with Law Society costs guidelines.
  • There will be costs on top of our fees, known as disbursements. These are fees and charges we will need to pay on your behalf as part of the process, such as Probate Registry fees, creditor advertisements etc.
  • Probate registry fees are £155, bankruptcy and Insolvency searches per beneficiary £7 plus VAT, AML verification admin fee is £20 per person plus VAT and Trustee Act notices start from around £185 including 20% VAT where relevant.

Our costs are based on the assumption that the estate is relatively simple, all based in the UK and that there are few, if any, assets that would complicate the process or lengthen our time estimates.

We understand the stress and emotion surrounding a recent bereavement.

The work we will carry out will involve:

  •  Ascertain the legally appointed executors or administrators and beneficiaries.
  • Applying for a grant of probate or letters of administration, including preparing HMRC forms (approximately 4-6 weeks from receiving asset information)
  • Obtaining the Grant of Probate and securely providing copies to you (approximately 3 months from receiving full and final details of the estate assets)
  • Ascertaining and collecting in the assets comprised in the estate (approximately one month after receiving the Grant of Probate)
  • Ascertaining and paying any liabilities on the estate (approximately 2-3 weeks thereafter)
  • Deciding upon and executing distributions of the estate in accordance with the will or intestacy rules
  • Obviously, our fees do not include any external costs and charges that we may incur as part of the administration (e.g. tax, penalties, repayable benefits, fees and charges). You will also be responsible for these items on behalf of the estate.

We would stress that the average costs and timescales outlined above apply to relatively simple estates (with UK only assets), which are not liable for inheritance tax.

We regularly deal with estates containing foreign (non UK based) assets. As those estates can be complex and time intensive we cannot provide you with an initial costs estimate and timescales for completing the work until we know what the assets are and where they are based.
